The most interesting question for me about how Washington and Colorado’s new marijuana laws will interact with contradictory federal laws is what conservatives will say about it. I’d love to hear a Fox News pundit say, “This is a states’ rights issue. If people in these states want legal marijuana, we can’t have our bloated federal government telling them what to do or, God forbid, stepping in to police them.”

If California is any indication, there will be some high profile busts of the most visible players for media purposes. I don’t expect the feds (ok, Obama) to turn a blind eye to it.
Don’t hold your breath for Fox to rush to support states’ rights. When the issue went to the Supreme Court in 2005, even Scalia was willing to temporarily put aside his views on federalism for what he viewed as a chance to stick it to the hippies out in California.

I doubt Obama has such a hard line on marijuana. According to a Frontline documentary that aired recently, he was an avid member of a pot smoking club called the “Choom Gang” when he was a teenager in Hawaii, making a dedication to the group in his high school yearbook. He has to follow federal law, but his history makes it hard to believe he isn’t sympathetic to legalization. This is all good news, since the drug war hasn’t gone so well, and a new approach is needed.
